1a – Legitimacy of the Crown?

1. Burden of Proof lies with the Crown and Commonwealth

• They claim sovereignty over land, people, and resources.

• They must prove the legal basis of that claim — via treaty, cession, or conquest.

• As per Mabo v Qld [No 2] and the ICJ’s Western Sahara Advisory Opinion, no such proof exists.

2. There Is No Valid Instrument of Sovereignty

• No treaty with Indigenous Peoples (as confirmed by both Houses of Parliament).

• No conquest or surrender recorded.

• Doctrine of “terra nullius” repudiated by the High Court in 1992.

• 1967 referendum did not amend sovereignty or recognise First Nations as subjects of the Crown.

3. Australia Acts 1986 failed to fix the void:

• No referendum (Section 128) was held.

• Both UK and Cth Acts attempt to legislate sovereignty through Parliament alone — legally and lawfully impossible.

4. All Courts and Laws Rest Upon Void Authority

• Ex nihilo nihil fit — From nothing, nothing comes.

• A Constitution enacted without free, prior, and informed consent of all Peoples (especially the first peoples) is void.

• Burden of proof is on the Crown to demonstrate a lawful, continuous, and valid title — and they cannot

Anthony albanese addressed a major gathering of Australian Aboriginal elders in Darwin. He spoke for almost an hour about his plans for increasing every Aboriginal’s present standard of living.
